These general terms and conditions of sale (GTC) govern the booking and participation procedures for guided tours offered by the Saint-Marcellin Vercors Isère Tourist Office.
All bookings imply full and unreserved acceptance of these terms and conditions by the client. We encourage you to read them carefully before making any booking.
ARTICLE 1 – IDENTIFICATION OF THE SELLER
These General Terms and Conditions of Sale (GTC) govern the sale of guided tours organized by:

The Tourist Office acts as organizer and seller of guided tours.
These Terms and Conditions do not apply to services offered by third-party providers via the website's marketplace.
ARTICLE 2 - OBJECT
These General Terms and Conditions define the conditions for booking, payment, cancellation and execution of guided tours offered by the Tourist Office.
ARTICLE 3 – RESERVATION
Reservations can be made:
– online via the website;
– by telephone;
– at the reception desk of the Tourist Office.
The reservation becomes firm and final upon receipt of payment.
For online bookings, confirmation via the "double click" technique and acceptance of these Terms and Conditions constitutes acceptance of the contract. A confirmation email will be sent to the customer as soon as possible.
For sales made at reception, payment constitutes acceptance of these Terms and Conditions, which can be consulted on site and on the website.
ARTICLE 4 – PRICE
The prices of guided tours are indicated in euros including all taxes (TTC).
The Tourist Office may apply different rates depending on the booking method. A preferential rate may apply for online booking and payment; this rate is displayed at the time of booking.
The applicable rates are those displayed at the time of booking or purchase. No rate adjustment requests will be accepted after purchase confirmation.
ARTICLE 5 – PAYMENT TERMS
Payment can be made:
– by bank card (online or at reception);
– by check made payable to the Saint-Marcellin Vercors Isère Tourist Office at reception only;
– in cash, at reception only.
In the case of online payment, the charge is immediate upon validation of the order.
ARTICLE 6 – NO RIGHT OF WITHDRAWAL
In accordance with Article L221-28 12° of the Consumer CodeLeisure services provided on a specific date or period do not benefit from the right of withdrawal provided for in Article L221-18 of the same code.
All reservations are therefore firm and final once validated.
ARTICLE 7 – CANCELLATION BY THE CLIENT
7.1 Cancellation Procedures
All cancellation requests must be sent to:
– by email to: tourisme@smvic.fr;
– or by registered mail with acknowledgement of receipt to the headquarters of the Tourist Office.
The cancellation is effective from the date and time the request is actually received. A cancellation confirmation email is sent to the customer; this acknowledgement of receipt constitutes the only legally valid proof of the cancellation.
7.2 Financial conditions
The following refund conditions apply:
– Cancellation received more than 48 hours before the scheduled visit time: full refund of sums paid.
– Cancellation received less than 48 hours before the scheduled time: no refund.
– Failure to appear on the day of the visit: no refund.
– Visit started: no refund, even partial.
Refunds are issued exclusively by bank transfer via the Public Treasury, to the bank account provided by the customer. Due to administrative processing times specific to public institutions, the refund will be processed within a maximum of 30 days from the date of cancellation confirmation.
ARTICLE 8 – CANCELLATION OR MODIFICATION BY THE TOURIST OFFICE
The Tourist Office reserves the right to cancel or modify a guided tour in the following cases:
– force majeure within the meaning of Article 1218 of the Civil Code;
– adverse weather conditions (storms, hail, heavy rain, heatwave, strong winds, official weather warning);
– exceptional unavailability of a place to visit (example: closure of a church for a religious ceremony or unforeseen event);
– unavailability of the guide due to illness, accident or major impediment;
– insufficient number of participants below the minimum required;
– security reasons or administrative decision.
Where possible, the Tourist Office will offer the client a postponement to a later date or a modification of the itinerary. The client will be informed as soon as possible using the contact details provided during booking.
In the event of a definitive cancellation initiated by the Tourist Office, the client will be fully reimbursed for the sums paid within a maximum period of 30 days, without additional compensation.
ARTICLE 9 – CONDUCT OF VISITS
After booking and payment, an electronic ticket is sent to the customer by email.
This ticket must be presented to the guide at the start of the tour, either on a smartphone or in printed form.
The meeting point and departure time of the tour are indicated on the electronic ticket.
It is the participant's responsibility to verify this information before the start of the tour.
Participants must arrive at the meeting point indicated on their e-ticket at least 5 minutes before the departure time.
The tour departs at the exact time indicated.
Any participant arriving after the group has left will not be able to be accommodated.
The service will then be considered as consumed, without the possibility of refund or postponement.
Participants must ensure that their physical condition is compatible with the visit.
They agree to follow the instructions given by the guide and to adopt a cautious and appropriate behavior for the conditions of the visit.
Each participant remains responsible for their own safety.
The Tourist Office draws participants' attention to the need to wear appropriate footwear and to dress according to the weather conditions.
In the event of inappropriate, disruptive or dangerous behavior, the guide may exclude the participant concerned from the tour, without refund or compensation.
ARTICLE 10 – RESPONSIBILITY
The Tourist Office is responsible for the proper organization of the guided tours offered.
Its liability cannot be invoked in the following cases:
– fault or negligence of the participant;
– failure to comply with the instructions in the guide;
– reckless or inappropriate behavior;
– cases of force majeure;
– accident that occurred outside the strict framework of the guided tour.
The Tourist Office reminds participants that minors must be accompanied by a responsible adult, who assumes supervision and responsibility for the minor throughout the visit.
ARTICLE 11 – INSURANCE
The Tourist Office is covered by a professional liability insurance contract for the organization of guided tours.
Participants are advised to check that their own insurance covers accidents that may occur during leisure activities.
ARTICLE 12 - PERSONAL DATA
The personal data collected during the booking (name, surname, contact details, payment details) are subject to computer processing based on the execution of the guided tour contract.
In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, each participant has the right to access, rectify, erase, restrict processing of, and object to the processing of their data. They may exercise these rights by emailing [email address missing]. tourisme@smvic.fr or by mail to the headquarters of the Tourist Office.

ARTICLE 13 – CONSUMER MEDIATION
In accordance with Articles L612-1 et seq. of the Consumer Code, every customer has the option of using a consumer mediator free of charge for the amicable resolution of a dispute.
In the event of a complaint relating to a guided tour, the client is invited to contact the Tourist Office in writing (email or letter) first in order to allow for the examination of their request and, if necessary, the search for an amicable solution.
If an amicable agreement cannot be reached with the Tourist Office, the client may contact the competent mediator whose contact details are as follows:

ARTICLE 14 – DISPUTE RESOLUTION AND APPLICABLE LAW
These T & Cs are subject to French law.
In the event of a dispute relating to their interpretation or execution, the client should first contact the Tourist Office to attempt an amicable resolution, before any legal action.
In the absence of an amicable resolution, the French courts shall have sole jurisdiction.
